Terms of Service — Emochi AI
These terms set out the agreement between you and Emochi AI. They cover who may use the service, what is allowed, how payments work and where responsibility sits.
Acceptance of these terms
By opening emochis.com or using any part of Emochi AI you agree to these terms. If you do not accept them, please stop using the service.
Eligibility
Emochi AI is available only to people aged 18 or over who have full legal capacity to enter a contract in their country of residence.
Nature of the service
Emochi AI provides entertainment through fictional companion characters. Companions are software characters and are not real people, regardless of how the conversation reads.
Account creation
You are responsible for the accuracy of the details you provide and for keeping your login credentials confidential. One person may hold one account.
Account security
Tell us promptly if you believe your account has been accessed by someone else. You remain responsible for activity carried out through your credentials.
Acceptable use
Do not use Emochi AI to harass others, break the law, distribute malware, scrape the service, or attempt to interfere with its normal operation.
Prohibited content
Requests involving minors, non-consensual scenarios, real identifiable individuals, extreme violence or illegal activity are forbidden and are grounds for immediate termination.
Automated access
Bots, crawlers, scripted clients and bulk data extraction are not permitted without written permission from Emochi AI.
Content you submit
You keep ownership of what you write and grant Emochi AI a limited licence to store and process it solely to deliver and maintain the service.
Content produced by companions
Replies are generated automatically and may be inaccurate, inconsistent or unsuitable for any particular purpose. Use judgement before relying on anything a companion says.
No professional advice
Nothing on Emochi AI is medical, psychological, legal or financial advice. Consult a qualified professional for decisions of that kind.
Emergency situations
Emochi AI is not an emergency service. If you or someone else is in danger, contact local emergency services or a recognised crisis line immediately.
Intellectual property
The Emochi AI name, interface, artwork, character profiles and written material are protected and may not be copied or reused without permission.
Limited licence to you
You receive a personal, revocable, non-transferable licence to use Emochi AI for your own non-commercial enjoyment.
Free and paid features
Some features are free and others require payment. The scope of each is described at the point of purchase before you commit.
Pricing and billing
Prices are shown inclusive of applicable taxes where required. Recurring plans renew automatically until cancelled.
Cancellation
You may cancel a recurring plan at any time from your account. Cancellation stops future charges and access continues to the end of the paid period.
Refunds
Refunds are handled according to the policy shown at checkout and to the statutory rights that apply where you live.
Chargebacks
Raising a chargeback without contacting support first may result in suspension while the matter is investigated.
Service availability
Emochi AI aims for continuous availability but does not guarantee uninterrupted access. Maintenance, updates and outages can occur.
Changes to features
Features may be added, altered or withdrawn. Where a change materially reduces a paid feature, we will give reasonable notice.
Third-party services
Payment, hosting and delivery partners have their own terms. Emochi AI is not responsible for how those independent services operate.
Suspension and termination
We may suspend or close an account that breaches these terms, harms other members or exposes Emochi AI to legal risk.
Your right to leave
You may close your account at any time. Closure ends your licence to use the service and starts the deletion process described in the Privacy Policy.
Disclaimer of warranties
The service is provided on an “as is” and “as available” basis, without warranties of any kind to the fullest extent permitted by law.
Limitation of liability
To the extent the law allows, Emochi AI is not liable for indirect or consequential loss, and total liability is limited to the amount you paid in the preceding twelve months.
Indemnity
You agree to cover reasonable costs arising from your misuse of the service or your breach of these terms.
Force majeure
Neither party is liable for delays caused by events beyond reasonable control, including outages, natural events and government action.
Governing law and disputes
These terms are governed by the laws applicable at the place of establishment of Emochi AI, without prejudice to mandatory consumer protections in your country.
Changes to these terms
Revised terms are posted on this page with a new date. Continuing to use Emochi AI after a change means you accept the updated version.
